1. Acceptance of these terms
By accessing xaundtech.com.ng, creating an account, using Xaund Tech tools or portals, submitting information, or booking a consultation, you agree to these Terms of Use and acknowledge the Privacy Policy. If you are using the website on behalf of an organisation, you confirm that you are authorised to do so.
2. About the website
Xaund Tech provides information about growth marketing services, free and account-based tools, content, consultations, project collaboration features and client-portal functions. Public website information is not a binding proposal, guarantee or promise of a specific commercial result.
3. Accounts and eligibility
Any eligible user may register for a Growth Hub account. Registration creates a free member account by default. Xaund Tech alone determines whether an account receives client access. You must provide accurate information, keep credentials secure, and notify us if you suspect unauthorised access.
4. Free members and client access
Free members may receive access to selected audits, tools, resources, saved results and booking features. Client-only functions may include projects, deliverables, reports, private files, invoices and other service-related materials. Client access does not arise merely because a user registers and may be enabled, changed, suspended or removed by Xaund Tech based on the service relationship.
5. Acceptable use
You must not misuse the website or portal, attempt to bypass access controls, access another user’s information, upload malicious code, interfere with platform operation, scrape the service at unreasonable scale, use the chatbot or forms to send spam, infringe intellectual-property or privacy rights, impersonate others, or use the service for unlawful activity.
6. Growth Audit, calculators, AI and free tools
Audits, calculators, templates, AI-generated responses and other free resources are general decision-support tools. Their outputs depend on the information supplied and may contain limitations. They do not constitute legal, tax, accounting, investment or other regulated professional advice, and they do not guarantee marketing or financial outcomes.
7. Consultations and service engagements
A consultation is exploratory unless the parties subsequently enter into a written proposal, statement of work, service agreement or other contract. The scope, fees, timelines, deliverables, intellectual-property terms and service-specific obligations for paid work will be governed by the applicable written agreement, not by general website copy.
8. Invoices and payment evidence
Xaund Tech may issue invoices through the client portal. Unless otherwise stated in the invoice or applicable agreement, invoice amounts are denominated in Nigerian Naira. Where payment is made outside the website, a client may upload proof of payment for verification. Uploading proof does not itself establish that payment has cleared or that the invoice is paid; Xaund Tech will verify the payment before updating its status.
9. Files, feedback and project materials
You represent that you have the right to upload files and materials you provide to Xaund Tech. You grant Xaund Tech the limited rights needed to host, access, process and use those materials for the requested service. Client confidentiality and ownership of paid deliverables may be governed by a separate service agreement.
10. Xaund Tech intellectual property
Except for third-party materials and client-owned content, the website, brand, software, text, design, tools, templates and other Xaund Tech materials are protected by applicable intellectual-property laws. You may use publicly provided resources for their intended purpose but may not sell, reproduce or redistribute substantial parts of the platform without written permission.
11. Portfolio and third-party marks
Client names, logos and case-study materials remain the property of their respective owners. Their display on the website is intended to identify work or relationships represented by Xaund Tech. Third-party links and services are governed by their own terms and policies.
12. Availability and changes
We may maintain, update, suspend or discontinue parts of the website or portal. We do not guarantee uninterrupted availability. We may change these Terms when reasonably necessary, with the updated version posted on this page.
13. No guarantee of results
Marketing performance depends on market conditions, competition, budgets, execution, customer behaviour, platform changes and other factors outside Xaund Tech’s control. Past case-study results are evidence of past work, not promises that another business will achieve the same result.
14. Limitation and responsibility
To the fullest extent permitted by applicable law, Xaund Tech is not responsible for indirect or consequential losses arising solely from use of free website content or tools. Nothing in these Terms excludes liability that cannot lawfully be excluded. Any paid-service liability terms will be governed by the relevant service agreement where one exists.
15. Suspension and termination
We may suspend or terminate access where reasonably necessary for security, abuse prevention, non-payment under an applicable agreement, violation of these Terms, or protection of other users. You may stop using a free account at any time and may request account deletion subject to legal and contractual retention requirements.
16. Governing law
These website Terms are governed by the laws of the Federal Republic of Nigeria. Any service-specific dispute process set out in a signed agreement takes precedence for that engagement.
